Commissioner trades barbs with HurstAntigua St John's - Police Commissioner Vere Browne and talk show host Lionel "Max" Hurst traded words on Tuesday over the top cop's refusal to allow "Minister of Helps" Eugene Humphreys to stage a protest march on Thursday.

Browne called the popular morning programme, Your View, where Hurst often appears as co-host, to clarify his rationale for denying permission.

The exchange, lasting just over 17 minutes, was heated at times as Hurst pressed the commissioner to give an explanation for his decision.

Hurst contended that the Constitution guarantees every citizen the right to peaceful assembly, and denial was tantamount to an infringement of that right.

“If the police are going to deny permission for a march, then they have an obligation to give a reason why the march is being denied," Hurst, a lawyer, declared. He added that "Citing sections of the requisite law as reasons for the denial is just not a proper reason in my view."

But the commissioner responded by reading from the Constitution to indicate that while an individual has certain rights, those rights have conditions or limitations. “The protection as contained in these provisions being limitations to ensure that the enjoyment of these rights and freedoms by the individual does not prejudice the rights and freedom of others or the public interest,” he said.

Browne explained that his decision was influenced by his concerns about the protection of the public interest and public order.


But not to be outdone, Hurst recalled that all previous police commissioners had cited reasons for denying any march, and in most cases gave an alternative date and time when the march could be held. He also said that the duty of the police is to ensure that when marches are held, they protect not only the marchers, but the property of others. “Antigua & Barbuda has a long tradition of democracy that includes the right to peaceful demonstration and you will not deny us that right,” he contended.

Host of the programme, James “Sly Jay’’ Simon, had a tough time moderating, as both men refused to accept the opposing point of view.

Browne stood his ground, and said his position is supported by the law and the Constitution. “The police enforce the law of the land, not my opinion," he said. "Mr Humphreys has received a response, and whether Mr Hurst or anybody disagrees with that, it’s unfortunate, but that’s the law of the land. That’s what we took the oath to uphold, and not Mr Hurst’s view."

On Monday, Humphreys shared the contents of a letter he had received from Browne denying permission to stage the march aimed at pressing the government to mount a public inquiry into what has become known as the "fences scandal".


On Tuesday night, ALP Leader Lester Bird added his voice to the debate, and said the commissioner’s argument was "spurious" and it was wrong for Browne to pre-judge the march, as this was "outrageous".

“The commissioner is allowing external forces to influence what he does,” Bird declared.

This is the same ex-minister, now senator, who is the head of National Security in Antigua. Does anyone else see how this appointment is causing an problems today within the Police Force?

I am not even asking for civil disobedience. That would just give the HNIC an excuse to flex his muscles. I saw him bring out the riot squad to enforce his idiotic decision to re-route the march up Long Street - when even the blind could see that the trucks could never make the turn. I am just asking the ALP to awaken from their deep slumber. The ALP should have already had people on the streets. They circulated petitions at the last public meeting. What has happened since? Absolutely nothing! The UPP claimed to have secured 10,000 signatures to force the MBS inquiry.

Gaston has been labelled, and it appears as if he is on a quest to repair his public image. Some of his recent pronouncements have really turned me off. He seems not to think that there is any urgency to remove this albatross from around our necks. I can't begin to say how unimpressed I am with the ALP as an opposition party - almost as unimpressed as I am with the UPP as a governing administration

It appears as if the ALP is in their comfort zone pontificating on this matter and doing precious little else. This burden should not fall on the shoulders of Eugene Humphries. As the main opposition party, the ALP should be in the front, leading the effort. Outside of a half-dead public meeting, all we have from the ALP is talk.

This sorry situation shows the ineptitude of the ALP as an opposition party. Had this sorry situation existed under the ALP administration, the UPP would have turned this country upside-down. Had the ALP been doing what they need to do, Eugene may not have even needed to apply for a permit to march. The ALP is too comfortable. They need to get up off their behinds and do some real work. We have long gone beyond the point of talking and writing meaningless letters.

It is obvious that funds are mis –appropriated. Look at the stadium at St. Johnston’s Village what garbage for 8 million. Me-musa- a –fooli. 40 plus million in fences and we can’t even keep meds in the hospital? Horrible roads, dirty water running through the pipes. I went to take a shower and was washed in mud the water brown. The question is who’s in charge? This March is an independent march. It is for and in the interest of the entire country so the fear is a lot of people will show up. Yes and I believe that the evidence is there to prosecute the culprits that is stealing from the treasurerary . The constitution give the people the right to assemble and so the Commissioner cannot predict the outcome so how can he know it would be a major public safety issue. A constitution is to be upheld even for the one good person who will do the right thing. Mr. Humphreys have no history of any violence and he is not affiliated with any fringe group. What a shame that an Antiguan came back home to contribute to his country and the first chance they get they violate their own people. The COP knows very well he is wrong and don’t care.

Mr Humphreys is NOT fronting for anyone. How on earth can marching for an enquiry into the massive theft of OUR tax money be a hidden front for the ALP? Obviously, the ALP, as opposition are supportive of the march…one would have to be an idealistic dunce to think that they would not be. The UPP were the same and would be the same as an opposition. The fact is that Eugene Humphreys like many of us wants an end to the corruption that is surely destroying Antigua and any successful future we might have. Antiguan Woman is correct in trying to get through to the narrow minded who refuse to come out of their boxes of perception that life is good in Antigua and it is perfectly ok for UPP to steal the crap out us because ALP did it too. Antigua is BROKE and there is no infinite money pit coming from an imaginary benefactor to support the theft and ineptitude that we are subjected to for the past 7yrs. BS and co. have more than shown that they don’t give a rat’s behind about the people (observe the obvious displays of personal wealth). It is all about greed, power and self preservation.

If you read any story on the COP's attack on our rights, you will see that the vast majority of us vehemently disagree with his actions. Throughout our history we have had marches that were always peaceful and uneventful until this ixiox became the chief cop. His first act was to change the route of a march simply to create a confrontation with the police. For eons we have been marching up Market Street and turning right onto High Street. In his infinite wisdom, he changed the route to go up Long Street. The trucks cannot make that turn. Up to now we are yet to hear the rationale for changing the route other than he has the right to do so.

Now this..... I was completely against the Canadian Mounties, but Gary Nelson resisted political interference into the police affairs, and left because he refused to be a puppet. At least he had some principles. This man is full of himself, and has absolutely no principles.

When I first heard about the COP decision, it really bothered me and I also agreed that it is the beginning of a dangerous precedent. If you look at it from another angle, while I do believe Min. of Helps may have a genuine desire to march peacefully, I would ask if he was fronting for the opposition and others to use this march to get what they have been unable to to get, namely protests on the fencing issue. If this was the case, how quickly we have forgotten that the last march was very confrontational with the Police regarding whether the march was to turn right on High Street or not. I still do not agree with denying peaceful marching but I assume he has weighed the last incident and made a decision.

Commissioner Browne, you, should have saved yourself the emb**ment by not calling into the talk show to clarify his position! It was a feable effort to get the support of the public behind you! The damage is already done, and, you need to really loosen those strings from you, or, you will be a Chief with no Indians running around to carry out the critical tasks of the Police! By the way, Commissioner, did you called into talk show willfully or by duress? You surely have a lot of time on your hands, when you should be out there solving unsolved crimes, and keep moral on the force at a high level! Mr.Commissioner , I really hope, you know which "oath" you took to "uphold?" Going forward, I will be watching you from the highest point with eagle's eye, so, will the concern citizens of this country!

Naiomi, I think you are quite correct. Many people fear this administration.
Make no bones about it, their favouritism toward some and outright spite for others has been on display for over 8 years now and it ain't pretty.
By and large Antiguans & Barbudans are peaceful people, but if Baldwin and company try to rig another election, we may see a big change.
Personally, I think they know this because otherwise they would let a simple protest march happen without interfering with police activities.
Such a meddlesome and manipulative bunch of miscreants indeed.

As I read these blogs something came to me and I realized that Antiguans and Barbudans are afraid of the UPP. Why? You all voted for them and if they are breaching the trust that was given to them shouldn't you all be saying so. You all can see that some type of dictatorship is coming to Antigua and Barbuda but instead you all try to put and end to it now what I am getting is that O if it comes well too bad we just have to live with it. what going to Happen is who can leave will leave and to hell with the others who will be tormented. I listened to the exchange between the Ixiox (COP) and Max Hurst. If Vere Browne has any shame left, he would just resign and go back under the rock from which he crawled. This is as bad a situation as I can imagine. Clearly, this man is nothing but a political puppet, doing the bidding of his masters.

If this man is really a trained lawyer, as he claims at every opportunity he gets, then this is proof that idiots can be lawyers too. The man sounded as if he had no common sense. I guess Vere Browne's duty includes protecting Baldwin Spencer and the UPP administration from criticism.

Vere Browne should try to improve his deplorable record in fighting crime and leave politics alone.

This is a strange decision of the Top Cop! Why deny Humpries? I have little time for Max Hurst who after all his academic Brilliance cannot even get a job other than to be Lester Bird's Gal Friday! But this has nothing to do with the right to march peacefully to protest something. Vere c'mon man! This government did not acquiesce to all the 'nationalist to get rid of the white man for an Antiguan for this to happen. This is not an action that is supported by the UPP administration who marched against injustice for years!

The decision to deny the permit smacks of political interference. The Commissioner must have realized that there was going to be significant political backlash, and to the degree he was going to deny the issuance of the Permit; the reasons he gave was not going to fly with the Antiguan and Barbudan public.
Irregardless of how much The Commissioner of Police may deny political considerations or influence in his decision few will accept it as being genuine, he has now made it a third rail issue. This one act may have cost the Commissioner the level of respect and forbearance that the highest lawman needs in order for him to be perceived as not being partisan or being manipulated.
This really sad, and one would have hoped that I spite of all our other problems this institutions that are the pillars of our democratic society would not have made a simple permit become now a political football

This issue is a constitutional issue, and clearly not party issue. And the COP decision not to allow the march would indeed set a dangerous president. I think that the COP decision should be challenged in court, and it has nothing to do with politics. So the I don't one has be ALP aligned to want the courts to rule on this very important issue. Has any UPP MP came out on the record to support this March?

Based on the numerous professional designations following his name (in his published response to Mr. Humphreys), it would appear that Mr. Brown has an advanced degree in law (LLM). Assuming he received this degree from a reputable institution, I am quite surprised that he would continue to try to make this a bigger issue than it is. He is right on at least one point...the people's right to freedom of expression and assembly must be balanced against considerations for public safety/order. But he is very wrong when he applies an arbitrary, discriminatory standard with respect to his denial of the application. If the standards are ambiguous, it will rightfully lead to the conclusion that the police is exercising bias as they subjectively review these applications from opposing groups. There should be rational objective standards that are applied to all applicants. Will the same standard that was utilized for Mr. Brown be used if the UPP (or even the ALP) makes a request for a public demonstration in the future? And why this deviation from established precedent, as stated by Mr. Hurst and others? Put your legal training to good use in this young democracy, Mr. Brown.

The decision was influenced by concerns for the public and to maintain public order. Question #1 protection from what and for whom. (2) Have we ever had a demonstration that has caused disruption of the public. These questions need to be answered by the Commissioner before he loses all credibility in the nations eyes.

He has contributed NOTHING to this country. He has lived out of Antigua his entire adult life. The BVI deemed him not good enough tp be Commissioner. But he is smart. He realised that if he tows the political line here, he will be able to take it easy, collect his salary and then in a couple of years, retire with full benefits.

Just a quick talley:
1. Control the media and deny the opposition party access...Check!
2. Manipulate the one and only election you presided over...Check!
3. Turn the Governor General's office into a political flunky....Check!
4. Take partisan control of the electoral commission....Check!
5. Deny a public enquiry into excessive spending on walls....Check!
6. Introduce new taxes and spend like crazy on nothing sustainable...Check!
7. Manipulate the police department regarding any decent....Check !
8. Treat the money men well (Waldorf) and keep them close to you....Check!
9. Give every MP duty free during the first weeks in office....Check!
10. Collect per diems with excessive travel and buy new cars with drivers, security teams and police escorts....Check!
11. Ignore the needs of the public unless they are contributors... Check!

Unless there is a history of Humphreys' marches causing trials and tributions for the pubic peace, then Commissioner Browne has nothing to protect. Perhaps Browne is aware of some plans afoot to disturb the peace and wants to wall this off. But that is no reason to stop the march. Browne needs to demonstate what elements of the peace he is bent on protecting.

That’s right Mr. Commissioner, do not let yourself be intimidated by those rabble rousers, serial marchers or serial bloggers the ones that come hear to criticize on a daily basis. If the person who promised to eat his shoes, along with the one’s that come hear to pontificate on their soap boxes everyday, particularly the ones questioning your competence have a problem with your decision to deny the march at this time, why don’t they challenge it in court? Am sure any number of ALP aliened lawyers will be happy to test your decision in court if they think it stand a chance.

But the issue here is much bigger, the trampling on the rights of individuals/gro ups in a nation to protest or demonstrate is being exhibited here, and with no explanation or plausible reason. So the Carnival revellers must take this to heart, for soon we may have a commissioner who says, hey you can't have jóuvert; the Christian churches should be aware, the commissioner may say, hey you can't have a crusade, the workers unions be aware, the commissioner may soon say you can't march for better working conditions. BE AWARE!! If we allow individuals to just take the crumbs from our rights, without showing our disgust, they will continuously take crumbs, until those crumbs become the whole bread/cake.

We are treading down a dangerous road in Antigua/Barbuda . The subtle nibbling at our constitutional rights, with or without reason, by anyone, is extremely dangerous. All NGOs, religious organizations, workers unions, and citizens of this nation, must not take this decision by the commissioner of police lightly. If we sit back and allow him to twist, pinch, tug at, erase, ignore, deny words, phrases of the law and his responsibility, we will end up treading on grounds to those in socialist/commu nists nations. Beware Antiguans/Barbu dans....Do not allow our rights to be trampled on by politicians, commissioners, or anyone for that matter. This is not a political issue, neither is it one to determine whether or not calling for an inquiry is warranted, (although I am one who wants to know whey me money garn).

Fence Scandal creates political barriers

Every government body in the world makes its fair share of missteps and mistakes. However, strong government bodies recognize those errors and develop processes to ensure they don't happen again.

It seems evident that the fence scandal is one of those issues that our current government refuses to accept responsibility for. Overlooking the situation and trying to bury it may result in voters changing their view on the government they selected.

Perhaps it's time for our current government to "man up" and investigate whether or not the scandal is legitimate. Otherwise we may see followers of "the blue" change their favorite color to red.

If there has been wrong doing, then we need them to set an example of those responsbile for it. If not, how can we ever demand the same from our citizens?

In my opinion, being a born Antiguan, and having lived here for all but about 4 years in the 1980's, something is fishy with this decision of the commissioner. What is the "public interest and public order" that will be endangered by this march? Give me a break Vere. You might have just returned to this country so you may be playing catch up but let me tell you, as bad as we all said Lester Bird and his administration was, we the citizens got the feeling that "we lived in a democracy". I expected a U.P.P government to have been an UPGRADE from the A.L.P. not going backwards in time. I have heard a number of police officers talk bad of you and I thought it was just politics on their part but trust me, having heard you on Z.D.K. my opinion of you have changed. In my humble opinion, we should be building a democracy and not try to emulate what we see happening to the people in the middle-east who are fighting tooth and nail for democracy. I thought we were past where they are. Seems like other people in this Antigua have other ideas. Eugene Humphreys did not get permission to march but he was successful in getting at least one person NEVER to vote for this U.P.P. again.
