Antigua St. John’s - Simon Davis was unanimously convicted Tuesday on eight counts of unlawful sexual intercourse with a female under the age of 16, and one count of buggery.
A 12-member jury comprising nine women and three men returned the guilty verdict after deliberating for less than two hours.
The convicted man will be sentenced on July 19.
Davis, 48, was accused of having sexual intercourse with a 14-year-old girl several times during September, 2010. He pleaded not guilty to all of the offences.
During the trial which commenced last week, the 16-year-old victim testified that Davis had sexual intercourse with her at her home, at his workplace and in some bushes.
Davis was a family friend who worked at a nearby garage in the village. While at work, he often got ice from the family.
The teenager, who cannot read, write, count to 10, or count from 10 to 20, said the first sexual encounter took place on her living room floor and she was asked not to tell anyone.
During her testimony, the child spoke of one occasion when the man had anal intercourse with her, which she recalled was painful and she told the court she felt “confused.” The teenager also said that, in one instance, Davis had intercourse with her while dropping her to school.
Reportedly, he dropped her off to school five or six times.
Davis told the police that the victim had indicated to him that she was 17 and a-half years old, an allegation that she denied.
Davis, of DeSouza Road, testified during the trial in his own defence. The Dominican-born native told the court that he cannot read very well. He said he fixes vehicles and air conditioning units.
The convict said he met the victim’s mother at the market and found out that she had a vehicle that needed to be repaired.
He said he became close with the family and was told by the victim that she had lost a baby.
Davis said he bought a pad for the child at Gloria’s Supermarket and following that she became stuck on him.
Contrary to the evidence given by the teenager, Davis told the court that he has never been inside the victim’s house.
He denied having intercourse with the child on the living room floor, but admitted to encounters at his workplace and in his vehicle.
He also denied that he buggered the young girl, stating that “I am not an anti-man.”
Davis said when he found out that the child was 14 years old and not 17 and a-half, he was frightened and shocked. He said he could not eat or drive that day.
Crown Counsel Adlai Smith prosecuted the matter, and Davis was represented by attorney-at-law Sherfield Bowen.

Some of you guys can blame the victim as much as much as you want, it does not change anything, he was convicted and now he will be assaulted in prison for many years to come. This is poetic justice. The system does work some of the time. Eventually, I do hope that he will be deported to Dominica.
The Antigua police force has a very lousy track record, and still there are so many foreigners convicted and jailed in Antigua for committing very heinous crimes. This tells me that the UPP and ALP politicians that are still thinking about freedom of movement for Caricom citizens are truly brain dead.

....When will mothers stop trusting unknown men with their children? Isnt it becoming more and more obvoius that girls are to be protected? Where is her father there was not mention of "daddy"
How comfortable was it for him to be told that she had just lost a baby and needed pad? There are such sick men out there. He needs to return to Dominica.
