Former workers within the Stanford Financial Group are trying to avoid giving testimony in an insurance coverage trial preceding the former financier's criminal hearing.
Laura Pendergest-Holt, who earlier petitioned for a separate criminal trial, is now fighting to prevent Lloyd's of London from trying to "place the civil cart before the criminal horse". This is also the view of her co-accused, former chief accounting officer Gilbert Lopez and former global controller Mark Kuhrt.
Lloyd's wants them to provide written statements in the matter. However, the defendants' lawyer is arguing that any evidence given could be used against them in later hearings. If they opt not to testify, in order to avoid self-incrimination, assumptions could be drawn about their guilt, and this could lead to a victory for Lloyd's, which is being forced to pay for their defense.
The trio's lawyer said instead, the insurance matter should be heard after the criminal trial, when Lloyd's should be allowed to sue for reimbursement, if applicable.
