Cabinet sub-Committee To Consider WPP Investigation Request

The sub-CommitteeAntigua St John's - The United Progressive Party (UPP) government continues to send out mixed signals on the way forward regarding requests for an investigation into the Wadadli Power Plant (WPP).

Mere days after Prime Minister Baldwin Spencer said he thought the move would be a waste of time and money, UPP Chairman Harold Lovell has announced the establishment of a Cabinet sub-committee to consider the request of Antigua Labour Party (ALP) Chairman Gaston Browne for an independent investigation into the project.

In a correspondence dated July 5, 2012, Lovell has advised Browne that with respect to his June 25 letter to Spencer, a Ministerial Sub-Committee of the Cabinet will be constituted to study the issues carefully.

“As promised in your subsequent meeting with the Prime Minister, the matters raised in your letter were discussed at the Cabinet meeting held on Tuesday, 3rd July, 2012,” Lovell tells Browne. He added, “Accordingly, a Committee has been established comprising Sen. the Hon. Dr. Errol Cort, Hon. Dr. Jacqui Quinn Leandro and myself, with a mandate to report to the Cabinet within fourteen (14) days.”

This report will determine whether or not the requested independent investigation will go forward.



Gaston Browne said he welcomed the news that the government not only opted to discuss his proposal but is looking to have focused talks on the matter before a final decision is taken.

He said he is not too focused on an immediate commission of inquiry considering the time and resources that would require, but is instead expectant of an investigation that could eventually open the door for the Commission of Inquiry on solid grounds.

“I got that they (government) are saying that they have established a cabinet sub-committee comprising three members to look at the issues raised in my letter, which is mainly about calling an independent investigation or commission of inquiry into the power plant engines. And they are to formally consider the request and to let the Cabinet know their decision regarding what action should be taken,” Browne said. “They have given themselves 14 days to make a final decision.”

Further, he said, any one of three positions could be taken within the next fortnight including the move to a Commission of Inquiry, an Independent Investigation or simply ignoring the request altogether.

The ALP executive had initially made requests for a Commission of Inquiry and not an independent investigation, and according to Browne, his flexibility in his request could well be the foundation for proper insight into the true nature of the WPP agreement.

My fellow bloggers, this may sound kinda harsh but i am not too surprise as to the actions of Prime Minister Balwin Spencer and his UPP colleagues. Looking at the UPP's tenure for the past eight years, i have witnessed on many occasions, their deliberate disregard for the rule of law. They have demonstrated to the nation many times that it's their way or no way, even if it's plain as daylight that their actions are wrong. What is very surprising to me is, I HAVE'NT HEARD A WORD FROM ALL THE NON GOVERNMENTAL ORGANIZATIONS THAT EXISTS PRIOR TO 2004; WHERE ARE THEY? ARE'NT THEY SUPPOSE TO BE THE INDEPENDENT VOICE OF REASON? WHERE ARE THE CHRISTIAN COUNCIL? ARE'NT THEY SUPPOSE TO BE GOD'S REPRESENTATIVE TO KEEP GOVERNMENT IN CHECK WHEN IMMORALITY IS EVIDENT? ARE'NT THEY THE ONES THAT SPEAKS ON BEHALF OF THE VOICE OF THE POOR AND DOWN TRODDEN? WHERE ARE THE INDEPENDENT VOICES OF MEN AND WOMEN WHO WOULD SPEAK TRUTH TO POWER WHETHER IT GOES AGAINTS THEIR ASSOCIATES AND FRIENDS? Young analyst, I would be shocked if the sub-committee recommends an investigation and the recommendation is accepted. I believe it is safe to say that the vast majority of Antiguans believe that there will not be any investigation and even if by chance, one is commissioned, the conclusion will be one, that we all can expect – no problem man!

Therefore, it is my humble opinion that a “class action lawsuit” is brought on behalf of the taxpayers. Where are the legal beagles? What are they afraid of?

The points I raised are not conclusive. I am sure they are much more information to be included. Some of the luminary bloggers, skilled in research, can add more to the motion.

By no means is this issue the only issue worthy of a “class action lawsuit”. There are many issues, discussed here on CA, that could comprise separate “class action lawsuits” I firmly believe that this is the only way to get transparency and accountability and to keep the powers that be in check.

Very detailed layout. I hope someone give some thought to our outline as a blueprint for some legal action to get to the bottom of this saga. However, this being ANU, you might be better off leading the charge yourself, because too many of our legal minds seem to lack the mettle to stand up on behalf of the citizens. Tenman, it is just "amazing" that we have a "Constitutional Monarchy" state but yet we have a "wanna-be" Prince, who just can't stop seeing the populace as mere "subjects!" Like I said before the Chief Servant biggest "enemy" is the "Machiavellian Doctrine!" So far, his actions\inactio ns in governing the people would lead any "fair-minded" persons to conclude that the "end will always justifies the means!" He didn't called his own people "criminals" and "mercenaries" for name-sake! And, only time will show that these "hand-picked" Sub-Committe state officials will give the "end" results have he needs to validify his stance against WPP! We have seen it with the Fencing scandal, where the Senator was given a "slap-on-the-wr ist," and the peoples moneys were never gotten "value" for all the contracts that were awarded to friends and party-hacks! What really amazes me is that we have "loyal" institutions" who knows of the Chief's "Machiavellian" tendercies but "failed" to stop him in his tracks!

5. Failure to follow the APUA engineer’s commendation, to wit: failure to ensure that the APUA engineers return to China to follow up on problems that were encountered during the initial testing of the engines.

6. There is evidence of potential fraud, to wit: There is a big discrepancy in the price paid for the engines as posted on the internet by the manufacturer compared to price proffered by the powers that be.

These allegations are by no means inclusive and will also have to be developed. I am certain that there are many more that could be added.
If done properly, this will have a bigger effect than an investigation because it will be conducted in the open.

The blogger, young analyst, asks, “what are they going to investigate?” In stead of questions for an investigation, let’s make the charge in a “class action lawsuit”. Here are some allegations for the motion:


1. Failed to follow Justice Mitchell’s recommendations to wit: to seek senior legal advice particularly from an attorney with experience in this area, before entering into any contract with any entity about power generation or other major equipment.

2. Violated the Finance Administration Act of 2006 to wit: (1) Failed to bring to parliament as required by the ACT and (2) refused to make critical documents related to the project available to members of parliament.

3. Violation of the Tenders Board Act, to wit: (1) failed to submitted the proposal to the Tenders Board for vetting as required by the Act, and (2) Failed to obtain a waiver from Tender’s Board.

4. Violation of the Public Accounts Committee rule, to wit: Refusal of certain officials to appear before the Public Accounts Committee.

Many have tacitly disagreed with my call for legal action and that is okay. But we can be assured that an investigation will not happen. This sub-committee appointed by the PM is nothing more that an attempt to placate the people. Almost all of the members of the ruling party have strong feelings contrary to most Antiguans. So, it is almost certain, that even if this sub-committee recommends an investigation, what are the changes that it would happen? I would not want to bet the ranch! More over, we can rule out a COI, since the GG has already rendered her decision. She can still change her mind, but I would not want to bet the farm.

I applaud the blogger Naomi, who wants to initiate an investigation of her own. This is noble, but one has to be realistic. If elected opposition members cannot get information, I do not think a private individual or group would have any success either.

I still firmly believe that the best way to approach this issue and to get to the heart of the matter is a “class action lawsuit” brought on behalf of the taxpayers of Antigua.

young analyst, they will be weighing the pros and cons for an investigation. Their particular interest will be: is the political risk of an investigation too high vs the rewards. This is the reason why politicians are heading the investigation.L ogically they know that any real investigation calls for a rejection of bias, but this is about politics. In their world, the ends justify the means so if they conclude that an investigation will cost them too much politically, it will not happen.

I am curious as to what exactly would they investigate? would it not be what evidence given to them? would they not just look on the surface? is it that they are investigating if the engines were new or if it was value for money? what are they going to investigate? He need to tell us so when the results comes we can say ok x or y!!

There appears to be "...MERIT" in each of these commentaries.

There are two interesting paragraphs "4" that speaks to a quote "...with a mandate to report to Cabinet within fourteen days." This appeared rather vague. Then there is a one line paragraph "5" that apeared "...speculative " in the absence of "...embodiment and Terms of reference." The question is "...What specifically was the Sub-Committee established to do that it may report in 14 days?"

Clearly, the Honourable Prime Minister had done exactly what he had promised "...take MP Browne's concerns to Cabinet." That was a very smart thing to do.
However, the composition of the Sub-committee with Ministers who had previously made their "...position" publicly known that "...there was no need for public inquiry," may have been prudently omitted, if their "...report" may reflect "...objectivity and avoidance of negative public perceptions."

There is nothing "muddier" than having a "Smooth-talker Piranha," a "Slippery Doctor Fish," and a "Wishful Eel" coming up with a "mandate" to report back to "Cabinet!" The fact they give us "14 days" to so is enough time for them to make the waters more "murky" from the public "speculation" and make it even "clearer" for the leader of cabinet, who already told us the engines are "new" and "up and running!" If they decided not to have an "independent investigation," how will the Loyal Opposition go forward, since it is more as a matter of "sit-and-wait" with them than "mobilizing" the people, who really believe that we were given a "six-for-nine?"

This has to be the last straw. Dr. Dr. and his government cannot sink any lower. Imagine setting up a committee from within the same people who need investigating for the issue at hand. The whole world is now laughing at us. I wonder why the major news networks of the US don't come down here; there is no bigger story anywhere in the world. Erol and Harold are two of the most notorious liars this world has known and then you add 'Poor Jacqu' to the mixed; the signs are all there that nothing will come out of this. The people of this coutry will have to send a message to this government that this is unacceptable. I must congratulate the powers that be for attempting to ascertain whether an investigation is warranted. However, we already know the outcome of this phony sub-committee. Many bloggers have already cited the personal feelings of the sub-committee members, so I will not repeat them here.

I believe that the PM is just throwing the good people of Antigua a bone in order to appease them temporarily. However, the PM would have had more credibility if he had created a bi-partisan sub-committee, consisting of three UPP and 2 ALP members. Better yet, in addition to the five members stated above, the PM could have also appointed two citizens, from each party, to the committee to assist. The present constitution of the sub-committee is nothing more that the fox guarding the chicken coop.

With that said, I hope the sub-committee will make their findings to support their decision available to the public.

The more i read this article and think back on all that has transpired since the story broke about the WPP, i have come to realize that the UPP is coming up with all kind of strategy to buy time with hope that this burning power plant issue will just fade away. We the citizens have been carrying the burden of high taxes, high utility cost, no availability of decent jobs due to high un employment and this is because we have an enept buch of individuals who claimed they were ready for the rescue in 2004. The result to this day is nothing short of percecussion and victimization. We will not relent on this WPP, UPP. The longer you delay, the more assertive we will be. This is like the straw the broke the camels back.

What ALP Brown need to understand is that this polical game is of a very high level startegy. There is no other reason but to buy time to put things in place that are not yet in place. And to not allow the ALP supporters to get more public support especially during Carnival when more Antiguan residence from overseas are at home. ALP should have use this time to show to the m** and send out their message and get increase support and sympathy for their call. But they will miss this oppertunity and the Antiguans living abroad will be gone soon again. ALP don't get side tracked. And remember there are moles amoung you.

The committee chosen by cabinet is nothing short of just ridiculous. Here you have two finance ministers who shares the blame for the finincial peril the country now face because of mal spending on questionable projects, that contributed little or no value to our economy. Their has been no financial audit presented to the accounts committe for at lease 6 years, no accountability for the Romantic Rhythm concert, the fencing scandal, the purchasing of of at least 4 buildings for price way above market value, and another big slap in the nations face, a white elephant called the sunshine hubb car park, an unfinished structure that has almost doubled the estimated U$25 million dollar price tag. You have an education minister who has been quite vocal in parliment and on the platform, in supporting her govt for the above mentioned and more. Which one of these individual can be considered to be impartial when conducting a serious assignment like this? My fellow citizens, our govt has no respect for us. We need to think about country and self and stop thinking along party lines and take the fight to the govt. We are the ones who suffers from governments draconian tactics. Enough already

Please note that as part of the Sub-Committee’s investigation will have to include the questioning of Gaston Browne about his statement that his party members were paid to start the rumor that the engines at the WPP were old. We need to know what he knows and when he knew it. This knowledge will solve a lot of problems.

With all fairness, this committee is not investigating. They are to make recommendations as to whether there should be a public inquiry or an investigation. The fact that they are studying the issue raises the expectation for action instead of ignoring the issue. I think there has been some progress and they will certainly be playing themselves if they fail to act.

Either Gaston is very stupid or this is a plan worked out between him and Dr. Dr. BS. All that will happen now is that they will set up a one man commission with a specially hand picked person. That person's report will say that even though APUA engineers screwed up, the generators are new and we got value for money. Story done.

More empty promises again? This is so funny I can't even laugh - so the same people who vehemently argued that the WPP is indeed new and that ANU got value for money will comprise this committee? What a joke, it is like having a burglar install your home security system.

Prime Minister Spencer was adamant that there was no need for public inquiry. Governor General Louise Lake-Tack shared same view.

Then when a no confidence motion was proposed on the same issue, there were those on this sub-committee who had pledged support to PM Spencer and said at a public meeting **Nobody send no text to ask me how me ah go vote.**

MP Gaston Browne wrote the PM Spencer asking for inquiry or investigation. He said he attended a meeting, sent out a release saying one thing, the PM offering to take his concerns to Cabinet, but said something totally different to Browne who said the PM **acknowledged the gravamen of the issues.**

Why Minister Harold Lovell had to write to Browne and not the PM? Why nothing from the Cabinet Secretary Hazel Spencer to confirm such discussions and decision to establish sub-committee had taken place.
This looks very much like mockery and making a Billy Goat of somebody.

I thought the PM said that there was no need for any investigation. Seems like we "backing back". But seriously, with this ministerial committee, I do not believe anything will come of this issue. I think when the PM declared that there was no need for an investigation, he was simply prefacing what this committee will conclude. Go figure!

THIS IS NOT FUNNY ANYMORE. YOU HAVE A PRIME MINISTER WHO HAVE ON MORE THAT HALF DOZEN TIMES PUBLICLY STATE THAT HE IS ABSOLUTELY SURE THAT THE GENERATORS AT WPP ARE BRAND NEW. WHAT IS THE PURPOSE OF THE SUB-COMIMITEE FOR? ARE WE TO BELIEVE THAT THE COMMITTEE AFTER SPEAKING WITHE OPPOSITION WILL COME BACK TO THE P.M WITH A DIFFERENT CONCLUSION? THESE PPL MUST BE TAKEN THE PEOPLE OF THIS COUNTRY FOR FOOLS.
I WOULD LIKE TO APOLOGISE TO THE ALP FOR REMOVING THAT IN 2004, I AM SO SORRY. WE THE PPL WERE FOOL INTO BELIEVING THAT THE UPP WERE HONEST BUNCH. WE REALLY THOUGHT THEY WERE BETTER, BUT THE LAST EIGHT YRS HAVE PROVEN OTHERWISE

Was it not the same ISSUE,MP Daniel sent a letter to the CHIEF SERVANT BS,and the same MP LOVELL,said the UPP CABINET and PARTY BIG WIGS met and they ALL AGREED that the ISSUE of the CHINIES/WPP SHOULD NOT BE INVESTIGATED ?
Please think back on the FENCING INVESTIGATION and the RESULT.
